These Terms & Conditions apply to all photography services provided by Alessandro Pietrosanti (“the Photographer”). By confirming a booking, paying a deposit, or commissioning work, the Client agrees to be bound by these Terms & Conditions.
1. Copyright & Ownership
All images produced by the Photographer remain the sole copyright and intellectual property of the Photographer at all times, in accordance with the Copyright, Designs and Patents Act 1988.
No ownership or copyright is transferred to the Client unless expressly agreed in writing and subject to an additional fee.
2. Image Licences & Usage
Upon full payment, the Client is granted a non-exclusive licence to use the images strictly in accordance with the licence agreed at the time of booking.
The available licences are:
Editorial Use Licence
For non-commercial use such as editorial content, blogs, personal websites, and personal social media.
Licence duration: 1 year.
Commercial, advertising, or promotional use is not permitted.
Commercial Use Licence
For commercial, marketing, promotional, and advertising purposes related to the Client’s business.
Licence duration: up to 5 years.
Unlimited Use Licence
For use across all media, platforms, and purposes, both digital and print.
Licence duration: up to 20 years.
Unless otherwise agreed in writing:
- Licences apply only to the Client named on the invoice
- Licences do not transfer to third parties
- Copyright remains with the Photographer
Any use outside the agreed licence requires prior written consent and may be subject to additional fees.
3. Third-Party Use
Third parties (including designers, agencies, publishers, magazines, or media outlets) must obtain written permission from the Photographer before using any images. Additional licensing fees may apply.
4. Credit & Moral Rights
Where reasonably possible, the Photographer must be credited when images are published or shared. The Photographer retains all moral rights.
5. Payment Terms
A 50% deposit is required to confirm the booking and secure the agreed date(s).
The remaining balance is payable on the shooting day or the day before image delivery, whichever comes first.
No images, licences, or usage rights are granted until full payment has been received, unless otherwise agreed in writing.
6. Booking Confirmation
A booking is considered confirmed once written confirmation is received and the required deposit has been paid. The Photographer reserves the right to decline or reschedule work if payment terms are not met.
7. Cancellation & Postponement
Cancellations or postponements must be notified in writing.
The following fees apply:
- Less than 2 business days’ notice: 30% of the agreed fee
- 1 business day’s notice: 70% of the agreed fee
- Same-day cancellation: 100% of the agreed fee
Any expenses incurred up to the time of cancellation remain payable.
8. Client Responsibilities
Client Representative
The Client is responsible for ensuring an authorised representative is present during the shoot. If no representative is present, the Client accepts the Photographer’s professional judgement. Images may not be rejected based on style, composition, or subjective preference.
Access & Permissions
The Client is responsible for providing access to the location and for obtaining all necessary permissions, including model releases, property releases, and location approvals.
9. Releases & Clearances
Unless provided by the Photographer in writing, no model or property releases are included. The Client agrees to indemnify the Photographer against any claims, damages, or legal costs arising from failure to obtain required permissions.
10. Retouching & Post-Production
Standard post-production includes basic colour correction, exposure adjustment, and light clean-up.
Any additional or advanced retouching will be quoted and charged separately and must be agreed before work begins.
11. Storage & Archiving
The Photographer will store final images for up to 2 years from the shoot date. After this period, images may be deleted without notice. The Client is responsible for long-term archiving after delivery.
12. Weather & External Conditions
Where weather or external conditions affect the shoot, alternative dates or reshoots may be agreed in advance. Additional costs may apply.
13. Limitation of Liability
The Photographer will take reasonable professional care but shall not be liable for:
- indirect or consequential losses
- business interruption
- delays caused by circumstances beyond reasonable control
The Photographer’s maximum liability is limited to the total fee paid for the assignment.
14. Governing Law
These Terms & Conditions are governed by the laws of England & Wales, and the parties submit to the exclusive jurisdiction of its courts.
